01Agreement to these terms
These Terms of Service (“Terms”) are a binding agreement between you and RUS Recruiting (“RUS,” “we,” “us”), 11710 Plaza America Dr, Suite 2000, Reston, VA 20190. They govern your use of rusrecruiting.com and its content, forms, job listings and resources (the “Site”), our text message program, and any request for services you make through the Site. By using the Site you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.
You must be at least 18 years old to use the Site. If you use the Site on behalf of a company, you confirm that you are authorized to bind it to these Terms.
Please read the “Dispute resolution and arbitration” section carefully. It requires most disputes to be resolved by individual binding arbitration and waives class actions and jury trials, unless you opt out as described there.
02Key terms
- “Client” means an employer or organization that requests or receives recruiting or staffing services from RUS.
- “Candidate” means a job seeker or professional who applies through the Site or works with RUS to find a role.
- “Contract Professional” means a Candidate employed or engaged by RUS and assigned to work for a Client.
- “Services” means contract staffing, contract-to-hire, full-time placement, executive search and related services.
- “Service Agreement” means a signed client services agreement, staffing agreement, search agreement, job order, statement of work or similar written agreement between RUS and a Client.
03Scope of services
RUS provides recruiting and staffing services to Clients and career services to Candidates in five practice areas: finance and accounting, technology, marketing and creative, legal, and administrative and customer support. Requesting talent or submitting a resume through the Site starts a conversation; it does not by itself create a contract for Services.
Services to Clients are provided under a Service Agreement. If a Service Agreement conflicts with these Terms, the Service Agreement controls for those Services. Where a Client receives Services without a signed Service Agreement, these Terms and our standard rates in effect at the time apply.
Our services are free for Candidates. RUS never charges job seekers a fee to apply, interview or be placed.
Content on the Site, including articles, salary data and guides, is general information and is not professional advice. See our Disclaimer.
04Acceptable use of the Site
You agree not to:
- Submit information that is false, misleading or that you do not have the right to share
- Apply for or request services on behalf of someone else without their permission
- Scrape, copy or harvest content, job listings or contact details from the Site using automated tools
- Interfere with the Site's security or operation, bypass our bot protection, or attempt to access areas you are not authorized to use
- Upload malware or files that infringe others' rights
- Use the Site to send spam, impersonate RUS or a recruiter, or run recruitment scams
- Use the Site for any unlawful, harassing or discriminatory purpose
05Candidates: applications and representations
Job listings describe roles in good faith but can be filled, changed or withdrawn at any time, and pay ranges are estimates. A listing is not an offer of employment, and submitting an application does not guarantee an interview, placement or employment.
By submitting a resume or application you confirm that the information is accurate and complete, that you are legally authorized to work in the United States or will tell us if you need sponsorship, and that you allow RUS to contact you and to present your profile to Clients after you agree to a specific role. Any background check, drug screening or other screening happens only with your separate written authorization.
06Clients: requests, conversions and worksites
When you request talent, you agree to give us accurate information about the role, its requirements, pay, worksite and timeline, and to use our Services in compliance with all applicable employment, anti-discrimination, wage-and-hour and immigration laws.
Candidate introductions. Candidates we introduce are presented to you in confidence. Unless your Service Agreement says otherwise, if you or your affiliates hire or engage, directly or through another party, a Candidate RUS introduced within twelve (12) months of the introduction, you will owe RUS a placement fee at our standard rate in effect at the time.
Worksites. For Contract Professionals on assignment, you are responsible for supervising their daily work, providing a safe workplace that complies with OSHA and applicable state safety laws, disclosing known hazards and site requirements in advance, and not assigning them duties outside the agreed job description without our written approval.
07Fees and payment terms
Fees, rates, placement fees and payment terms are set out in your Service Agreement. Where a Service Agreement does not address a point, the following applies:
- Invoices are due on receipt and payable in U.S. dollars.
- Contract staffing is invoiced on the hours shown on approved timesheets. Failing to approve or dispute a timesheet by the deadline in the Service Agreement means the hours are treated as approved.
- Any invoice dispute must be raised in writing within ten (10) days of the invoice date, describing the disputed amount. You must pay the undisputed portion on time.
- Late payments accrue a late charge of one and one-half percent (1.5%) per month or the highest rate allowed by law, whichever is lower, and you agree to pay reasonable costs of collection, including attorneys' fees.
- Fees exclude sales, use and similar taxes, which you will pay where applicable.
- RUS may suspend Services, including removing Contract Professionals from assignment, if undisputed amounts remain unpaid after written notice.
08Changes to job orders
A job order or search may change after it starts, for example in its scope, requirements, pay or bill rate, schedule, location, headcount or start date. Any change must be agreed in writing (email is enough) as a change order that describes the change and its effect on fees and timing. Until a change order is agreed, RUS may continue to work to the existing job order. Changes requested after a Candidate has been presented or has started an assignment may result in additional fees or a revised timeline.
09Time is of the essence
Time is of the essence for each Client's payment obligations and for the approval, notice and dispute deadlines in these Terms and in any Service Agreement. Target timelines that RUS shares for shortlists or searches are good-faith estimates, not deadlines, unless a Service Agreement expressly makes them binding.
10Service warranty and remedies
RUS will perform the Services in a professional manner consistent with generally accepted industry standards. Any replacement guarantee, refund or free-replacement period applies only if it is stated in your Service Agreement, and only on its conditions, which normally include timely payment and prompt notice. Unless a Service Agreement says otherwise, your sole remedy for Services that do not meet this standard is for RUS to re-perform them or provide a replacement Candidate.
RUS does not guarantee the performance, conduct or continued employment of any Candidate. Except as stated in this section or in a Service Agreement, the Site and Services are provided without warranties of any kind, as described in our Disclaimer.
11Text message program (SMS)

Consent is not a condition of using our services or of any purchase.
- Message frequency varies based on your activity with us.
- Message and data rates may apply. Check your mobile plan for details.
- To opt out, reply STOP (or CANCEL, END, QUIT or UNSUBSCRIBE) to any message. We will confirm your opt-out with one final message and send no further texts unless you opt in again.
- For help, reply HELP or contact us at (571) 200-2004 or talent@rusrecruiting.com.
- Carriers are not liable for delayed or undelivered messages.
- You confirm that you are the account holder or an authorized user of the mobile number you provide, and you will tell us if you change or give up that number.
- Data use: we use your mobile number and messages only to provide this program, as described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
12Intellectual property
The Site and its content, including text, graphics, photographs, logos, salary guides, tools and articles, are owned by RUS or its licensors and protected by copyright, trademark and other laws. You may view and print content for your own non-commercial use. You may not copy, republish, sell or create derivative works without our written permission. “RUS Recruiting” and the RUS logo are trademarks of RUS. You keep ownership of materials you submit and give RUS a license to use them to provide the Services.
13Third-party sites and tools
The Site may link to or use services run by others, such as maps, security checks, video interview platforms and government data sources. We do not control and are not responsible for their content, availability or practices, and your use of them is subject to their own terms.
14Limitation of liability
To the fullest extent permitted by law, RUS and its owners, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or opportunities, arising out of or relating to the Site or these Terms, even if advised of the possibility of such damages.
For use of the Site, RUS's total liability is limited to one hundred U.S. dollars (US$100). For Services, RUS's total liability is limited as stated in the Service Agreement or, if it is silent, to the fees you paid RUS for the specific Services giving rise to the claim during the twelve (12) months before the claim arose. These limits do not apply to liability that cannot be limited by law, such as for gross negligence, willful misconduct or fraud.
15Indemnification
You agree to defend, indemnify and hold harmless RUS and its owners, employees and agents from any claims, losses, damages and expenses, including reasonable attorneys' fees, arising from your misuse of the Site, information you submit, or your violation of these Terms or of law. Clients also agree to indemnify RUS for claims arising from worksite conditions, Client supervision and direction of Contract Professionals, and Client employment decisions, except to the extent caused by RUS's own negligence or misconduct, or as otherwise set out in the Service Agreement.
16Force majeure
Neither party is liable for a delay or failure to perform caused by events beyond its reasonable control, including natural disasters, severe weather, epidemics, government orders, war, terrorism, civil unrest, labor disputes, utility or internet failures and cyberattacks, provided the affected party notifies the other promptly and uses reasonable efforts to resume performance. A force majeure event does not excuse payment for Services already performed.
17Suspension and termination
We may suspend or end your access to the Site at any time if we believe you have violated these Terms or misused the Site. You may stop using the Site at any time and may opt out of emails and texts as described above. Services are terminated as provided in the Service Agreement. Sections that by their nature should survive, including fees owed, candidate introductions, intellectual property, limitation of liability, indemnification and dispute resolution, survive termination.
18Dispute resolution and arbitration
Talk to us first. Before starting arbitration or a lawsuit, you agree to send a written description of the dispute to RUS Recruiting, Attn: Legal, 11710 Plaza America Dr, Suite 2000, Reston, VA 20190, or talent@rusrecruiting.com, and to try in good faith to resolve it for thirty (30) days.
Binding arbitration. Any dispute, claim or controversy arising out of or relating to the Site, these Terms or the Services that is not resolved informally will be resolved by final and binding arbitration administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules or, for an individual's claims, its Consumer Arbitration Rules. The Federal Arbitration Act governs this section. The arbitration will take place in Fairfax County, Virginia, unless both parties agree otherwise or the AAA rules allow a hearing by video or in the individual's home county. Judgment on the award may be entered in any court with jurisdiction.
Class action and jury trial waiver. Disputes will be resolved only on an individual basis, not as a class, collective or representative action, and you and RUS each waive the right to a jury trial.
Exceptions. Either party may bring an individual claim in small claims court, or seek a court order to protect intellectual property or confidential information. This section does not prevent anyone from filing a charge with a government agency such as the EEOC, NLRB or Department of Labor, and it does not apply to claims of sexual harassment or sexual assault that the law allows to be brought in court. Employment disputes between RUS and its own employees, including Contract Professionals, are governed by their employment agreements and not by this section.
Opt out. Individuals may opt out of arbitration within thirty (30) days of first accepting these Terms by emailing talent@rusrecruiting.com with the subject “Arbitration opt-out” and your name and email address.
Venue. For any dispute not subject to arbitration, you and RUS agree to the exclusive jurisdiction of the state and federal courts located in Fairfax County, Virginia (including the U.S. District Court for the Eastern District of Virginia, Alexandria Division).
19Governing law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law rules, and by applicable federal law.
20General terms
- Changes. We may update these Terms. The “Last updated” date shows when they last changed. Material changes apply going forward; continuing to use the Site after a change means you accept it.
- Entire agreement. These Terms, the Privacy Policy, the Disclaimer and any Service Agreement are the entire agreement about their subject matter.
- Severability. If any part is found unenforceable, the rest remains in effect, and the unenforceable part is limited to the minimum extent necessary.
- No waiver. Not enforcing a provision is not a waiver of it.
- Assignment. You may not transfer these Terms without our consent; we may assign them in a merger, acquisition or sale of assets.
- Notices. We may give notices by email to the address you provided or by posting on the Site.
